Florida Governor Ron DeSantis has become a favorite target of Democrats and their media allies. They accuse him of not caring about COVID risks because he has opened the Sunshine State for business while other states like California and New York have been locked down indefinitely.

But the truth is that Governor DeSantis has put the people of his state first. People need to work to earn a living and to support themselves and their families. Add to that the rise in isolation-related issues like substance abuse, depression, and suicide, and the case for reopening becomes clear. The media seem to gloss over those concerns when they deride Republican governors like DeSantis.

Despite the lockdowns in California and New York, those states are still leading the nation in number of cases and, in New York’s case, the number of deaths from COVID.

Though Florida has a larger senior population than New York, New York has had suffered more deaths from the virus.

If we are following the science, we would know that this virus spreads no matter what precautions are taken. There really isn’t much difference in the severity in locked-down states like New York and California, and reopened ones like Florida and Texas.

But that isn’t going to stop Joe Biden from considering banning travel to and from the Sunshine State.

That’s right, President Biden is considering a travel ban to Florida because of fear of a new strain of the virus that has appeared in the state from England.

The Miami Herald reported, “Outbreaks of the new variants — including a highly contagious one first identified in the United Kingdom, as well as others from South Africa and Brazil that scientists worry can evade existing vaccines — have lent urgency to a review of potential travel restrictions within the United States, one federal official said. […] Two federal government officials underscored that no policy announcements are imminent, and that any move to restrict travel or impose new health measures would be taken in partnership with state and local governments. The U.K. variant, known as B.1.1.7, has recently exploded in Florida, where over a third of all cases in the United States have been identified.”

But there is one problem with Biden’s proposition: It violates the Commerce Clause in the Constitution.

The Commerce Clause is meant to ensure that states remain open to trade with each other, and that means that Americans are allowed to freely move between states.

The Founders didn’t intend for the Federal Government to regulate every part of our lives. The Federal Government simply seized this power following the decision in Wicker V. Filburn during the FDR administration.

Law Professors Randy Barnett and Andrew Koppelma wrote the following about the Commerce Clause:

“To address the problems of interstate trade barriers and the ability to enter into trade agreements, it included the Commerce Clause, which grants Congress the power “to regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” Moving the power to regulate interstate commerce to Congress would enable the creation of a free trade zone among the several states; removing the power to regulate international trade from the states would enable the president to negotiate, and Congress to approve, treaties to open foreign markets to American-made goods. The international commerce power also gave Congress the power to abolish the slave trade with other nations, which it did effective on January 1, 1808, the very earliest date allowed by the Constitution.”

Joe Biden can’t claim to “follow the science” and uphold the Constitution of the United States if he goes through with this unconstitutional order.

But, hey, who cares about the Constitution. It is just a relic now. Well, that is what liberals would have us think.

Unfortunately for them, Ron DeSantis stands in their way…and as a Florida resident, I can say that he certainly won’t be taking this one lying down.
